Terms of Sale
These terms of sale govern the contractual relationship between MossPig Lab, publisher of the sweeprice.com service, and any customer making a purchase or subscription on the site.
1.Publisher identification
The sweeprice.com service is operated by MossPig Lab, a simplified joint stock company (SAS) registered in France. Hosting is provided by Scaleway (France and European Union).
2.Purpose
These terms define the subscription, use, and billing conditions for services offered on sweeprice.com, notably competitor price monitoring, change alerts and pricing rules.
3.Pricing and payment terms
The current prices are indicated on the site at the time of the order. Payments are made online by credit card via a secure service provider. Subscriptions are billed monthly or annually depending on the offer chosen. MossPig Lab reserves the right to change prices at any time, with new prices applying to subsequent renewals.
4.Duration and termination
Subscriptions run for a fixed term (monthly or annual) and renew automatically unless the customer cancels from their user space before renewal. Early termination does not trigger a refund unless the provider is at fault.
5.Right of withdrawal
In accordance with article L221-28 of the Consumer Code, the right of withdrawal does not apply to digital services performed immediately after validation of payment. By subscribing, the customer expressly accepts that execution begins before the end of the legal withdrawal period.
6.Customer obligations
The customer undertakes to provide accurate information on registration and to keep their credentials confidential. The customer is the sole decision-maker on their selling prices. It is their responsibility to enter and keep up to date their cost prices, floor prices and ceiling prices, to configure their adjustment rules, to check recommended prices before any application, and to ensure that their pricing practices comply with applicable regulations and with the terms of the marketplaces they sell on. The customer undertakes not to use the service for unlawful purposes, nor in a manner contrary to the terms of use of the monitored third-party sites.
7.Nature of the service and warranties
sweeprice.com is a decision-support tool. Monitored prices are observations of publicly accessible pages on third-party sites; recommended prices result from rules configured by the customer. They constitute neither business advice nor any guarantee of commercial outcome. MossPig Lab is bound by an obligation of means (obligation de moyens) and applies the reasonable diligence of a professional in the sector. The service is provided without warranty of continuous access, absence of error, or fitness for a particular purpose. Data comes from third-party sites over which MossPig Lab has no control. It may be incomplete, inaccurate, delayed or temporarily unavailable, in particular where a monitored site changes, where anti-bot protection applies, or where a marketplace programming interface (API) is unavailable or changes. No warranty is given as to the accuracy, completeness, freshness or continuity of the readings.
8.Automatic adjustment and price updates on marketplaces
The service may offer, marketplace by marketplace, automatic transmission of the recommended price to the customer's seller account (“automatic update”). This feature is disabled by default. The automatic update is not available during the free trial period: it is reserved for active paid subscriptions. Enabling it requires the customer's express consent, separately for each marketplace, after connecting their own seller credentials. The customer may disable it at any time, marketplace by marketplace, from their account. A simulation mode, which logs updates without transmitting anything, is made available; using it before any live activation is recommended. The customer acknowledges and accepts that: — they themselves define the bounds within which the automatic update operates (floor price, ceiling price, maximum permitted variation) and it is their responsibility to keep them up to date; — they declare being the only party modifying their prices on the marketplace concerned; the concurrent use of another tool, feed manager or export writing the same prices is their sole responsibility; — any price transmitted within the bounds they have themselves defined constitutes their own selling price, decided by them; — transmission depends on the marketplace's programming interface, its availability and its processing delays, over which MossPig Lab has no control; — the service may automatically suspend the update where an anomaly is detected, then falls back to making the price feed available only, without such suspension amounting to a breach. The customer remains responsible for the prices actually applied to their listings, including where they result from an automatic update they have enabled.
9.Limitation of liability
Indirect and immaterial damages are expressly excluded from any compensation, in particular: loss of turnover, loss of margin or profit, loss of business, loss of opportunity, loss of orders, loss of or damage to data, harm to image or reputation, third-party claims, and any measure taken by a marketplace against the customer (suspension or closure of the seller account, loss of featured offer placement, delisting). In any event, the total aggregate liability of MossPig Lab, on any ground whatsoever, is capped at the amounts actually paid by the customer over the twelve (12) months preceding the event giving rise to the damage. This cap may not be lower than one thousand (1,000) euros. Any claim must be notified in writing within thirty (30) days of discovering the fact giving rise to it. In accordance with article 2254 of the French Civil Code, any action based on this contract is time-barred one (1) year after the event giving rise to it. The foregoing limitations and exclusions do not apply in the event of wilful misconduct (dol) or gross negligence (faute lourde), nor where the law prohibits them.
10.Service credit
Where the service is unavailable, or price collection is interrupted, for a reason attributable to MossPig Lab, the customer may request a credit corresponding to the portion of the fee covering the affected period, calculated pro rata to the number of days concerned. The request must be made in writing within thirty (30) days following the end of the affected period. The credit is applied to the next billing instalment and does not give rise to a cash refund. This credit is the agreed remedy for unavailability and interruptions, without prejudice to article 9 for other damages.
11.Intellectual property
All elements of the site and service (brand, interface, code, visuals) are the exclusive property of MossPig Lab. No transfer of rights is granted to the customer outside of the strict use of the service.
12.Invoicing and accounting documents
Invoices are issued automatically after each payment and accessible in the customer area. The client is responsible for their retention for accounting purposes.
13.Suspension or termination by MossPig Lab
MossPig Lab may suspend service access in the event of non-payment, breach of the terms, or abusive use. Final termination may occur if a formal notice remains unresolved.
14.Governing law and jurisdiction
These conditions are governed by French law. Any dispute will be subject to the exclusive jurisdiction of the courts within the jurisdiction of the head office of MossPig Lab.
